Terms of Use

By downloading or using Arguox, you agree to these Terms of Use. If you do not agree, do not use the app.

1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the Arguox mobile application available on Android and iOS. By installing or using the App, you agree to be bound by these Terms and our Privacy Policy.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal or internal business purposes on devices you own or control.

You may not:

  • Copy, modify, or distribute the App or any portion of it.
  • Reverse-engineer, decompile, or disassemble the App.
  • Use the App to create a competing product or service.
  • Remove or alter any proprietary notices or labels.
  • Use the App in any way that violates applicable laws or regulations.

3. Acceptable Use

You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others. You are solely responsible for:

  • The content of photos you capture and the metadata you embed.
  • The API endpoint you configure and any data you send to it.
  • Obtaining all necessary consents from individuals who appear in your photos.
  • Complying with applicable privacy and employment laws in your jurisdiction.

You must not use the App to:

  • Capture or transmit photos of individuals without their knowledge or consent where required by law.
  • Falsify timestamps, locations, or any metadata.
  • Engage in any fraudulent, deceptive, or misleading activity.
  • Interfere with or disrupt any third-party services used by the App.

4. In-App Purchases

The App offers a one-time in-app purchase: Remove Ads Forever, which permanently disables all advertisements.

  • Purchases are processed by Google Play (Android) or Apple App Store (iOS).
  • The purchase is tied to your Google Play or Apple ID account and can be restored on any signed-in device via the Restore Purchase option in Settings.
  • We do not process, store, or have access to your payment information.
  • All purchases are final. Refunds are subject to the policies of the respective app store.

5. Advertisements & Connectivity

The free version of the App displays full-screen App Open advertisements powered by Google AdMob, shown after every 10 minutes of use. By using the free version, you consent to the display of these ads.

Because ads are served online, the free version requires an active internet connection. When no connection is detected, the App will display a connectivity notice and suspend normal operation until a connection is restored.

On iOS, you will be presented with Apple's App Tracking Transparency (ATT) prompt before ads initialize. On Android and in the EU / EEA on iOS, a GDPR consent form will appear before any ad loads. You may change your ad preferences at any time through your device's privacy settings.

Purchasing the Remove Ads option disables all advertisements permanently and removes the internet requirement, allowing the App to be used fully offline.

6. Third-Party Services

The App integrates with third-party services including OpenStreetMap Nominatim (geocoding) and Open-Meteo (weather, when enabled). Your use of the App is also subject to the terms of these services. We are not responsible for the availability, accuracy, or content of third-party services.

If you configure a Google Apps Script URL as your endpoint, your data is sent to and processed by Google's infrastructure under Google's Terms of Service and Privacy Policy. Arguox has no control over how Google stores or handles that data.

7. API Endpoints You Configure

The App allows you to configure external HTTPS endpoints to receive photo and metadata payloads. You are entirely responsible for:

  • The security and availability of your configured endpoint.
  • Any data stored or processed by that endpoint or by downstream services (e.g., Google Drive, Google Sheets).
  • Compliance with applicable data protection laws regarding the data you collect through your endpoint.

8. Intellectual Property

The App, including its design, code, trademarks, and content (excluding user-generated content), is owned by Arguox and protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that:

  • The App will be error-free or uninterrupted.
  • GPS coordinates or reverse-geocoded addresses will be accurate.
  • Timestamps will match legal time standards in your jurisdiction.
  • Queued uploads will always be successfully delivered.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, failed uploads, inaccurate metadata, or reliance on photos as legal evidence.

Our total liability for any claim shall not exceed the amount you paid for in-app purchases in the 12 months preceding the claim.

11. Termination

We reserve the right to discontinue the App or any feature at any time without notice. You may stop using the App at any time by deleting it from your device.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts of the Philippines.

Nothing in this clause limits your rights as a consumer under the mandatory laws of the country in which you reside.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and, where material changes are made, post a notice within the App. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

We recommend checking this page periodically for updates.
